Common Issues Arising upon Separation from Employment
IV. Employee Rights to Unemployment Compensation
Your right to unemployment compensation is generally governed by the Florida unemployment compensation statute.
First of all, unemployment compensation is not generally paid if you voluntarily leave your job. if, however, your employer causes you to leave your job, you may be eligible for benefits.
However, you may still be denied benefits if your employer successfully establishes that you were separated from employment for "misconduct connected with your work". Examples of such misconduct include theft, continued poor performance or excessive absenteeism.
It is up to you to refute the employer's showing of misconduct where you disagree.
